RULES AND REGULATIONS


THIS CONTEST IS OPEN ONLY TO RESIDENTS OF CANADA
AND IS GOVERNED BY CANADIAN LAW

Standard data rates apply to participants who choose to participate in the Contest via a mobile device.  Please contact your service provider for pricing and service plan information and rates before mobile device participation.

1.    KEY DATES:

The FIND THE CUP TO WIN Contest (the “Contest”) is brought to you by Kruger Products Inc. (the “Sponsor”) and begins on March 4, 2024 at 12:00:00 a.m. Eastern Time (“ET”), ends May 12, 2024 at 11:59:59 p.m. ET (the “Contest Period”).  

The Contest Period is divided into: (i) a purchase period, starting March 4, 2024 at 12:00:00 a.m. ET and ending May 4, 2024 at 11:59:59 p.m. ET (the “Purchase Period”); and (ii) a participation period, starting March 4, 2024 at 12:00:00 a.m. ET and ending May 12, 2024 at 11:59:59 p.m. ET (the “Participation Period”). 

2.    ELIGIBILITY TO ENTER: 

The Contest is open only to residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, officers, directors, representatives or agents (and those with whom such persons are living, whether related or not) of the Sponsor, the National Hockey League (“NHL”), its member clubs, NHL Enterprises Canada, L.P., NHL Enterprises, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), each of their respective distributors, representatives, agents, sponsors, parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).   

3.    AGREEMENT TO BE LEGALLY BOUND BY RULES: 

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”). 

4.    HOW TO PARTICIPATE:

NO PURCHASE NECESSARY. Making a purchase will not in any way whatsoever increase or otherwise impact your chances of winning in this Contest. You may enter the Contest as follows: 

(a) Obtain an Eligible UPC

During the Purchase Period, purchase any one (1) Kruger brand product sold from an authorized participating retailer in Canada (each, a “Participating Product”) obtain the UPC (an “Eligible UPC”) associated with the Participating Product purchased (collectively, an “Eligible Purchase”). 
NOTE: Please retain the original Eligible Purchase receipt, as it may be required to be presented to the Sponsor as part of the verification procedure outlined below (including, without limitation, verifying that the Eligible Purchase was completed during the Purchase Period). 

Alternatively, to obtain an Eligible UPC without making an Eligible Purchase, email (from your valid email address) a message that includes: (i) your first name, last name, telephone number, age, and complete mailing address (including postal code);  and, (ii) a fifty (50)-word or more unique and original essay telling us what you love about hockey;  to the following address:  findandwin@spidermarketing.ca (collectively, a “Request”). Upon receipt of a valid Request in accordance with these Rules, the Sponsor will provide one (1) Eligible UPC by reply email. To be eligible, a Request must: (i) be received separately (i.e., multiple Requests in the same email message will be void); (ii) be sent and received during the Purchase Period; and (iii) be in accordance with these Rules (all as determined by the Sponsor in its sole and absolute discretion). The Contest Parties and each of their respective agents, employees, directors, officers, successors and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, stolen, illegible, damaged, destroyed or incomplete Requests (all of which are void). 

AND

(b) Guess the Location of the Virtual Stanley Cup® 

Upon obtaining an Eligible UPC, during the Participation Period visit www.findandwin.ca (the “Website”) and follow the on-screen instructions to obtain the official Contest entry form (the “Entry Form”). Fully complete the Entry Form with all required information, which will include a requirement to: (i) enter your full name, valid email address, telephone number and mailing address (including postal code); (ii) enter an Eligible UPC; and, (iii) signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules. Once you have fully completed the Entry Form with all required information, follow the on-screen instructions to submit your completed Entry Form and ask to “Join the Hunt!” Next, you will be presented with an interactive map on the Website that you can navigate and position the marker as your guess of the exact location of the virtual Stanley Cup® that is hidden online (a “Guess”). 

Upon completing an eligible Guess in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), you will automatically receive one (1) entry (an “Entry”). To be eligible, your Guess must be submitted and received in accordance with these Rules (and any applicable instructions on the Website) during the Participation Period.  

5.    ENTRY LIMIT AND CONDITIONS:

There is a limit of one (1) Guess per person and per email address per Day. Each “Day” of the Contest begins at 12:00:00 a.m. ET and ends at 11:59:59 p.m. ET on a day during the Participation Period. Limit one (1) Guess per Eligible UPC. For greater certainty and the avoidance of any doubt, a limit of one (1) Eligible UPC may be submitted per person and per email address per Day, regardless of the method of obtaining such Eligible UPC.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, email addresses and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; (iii) falsely claim an eligible winner designation; and/or (iv) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Eligible Purchases, Eligible Purchase receipts, Requests, Request emails, Eligible UPCs, Entry Forms, Guesses, Entries and/or any other Contest-related information (collectively, “Contest-Related Information”), all of which are void. 

Any Contest-Related Information may be rejected if, in the sole and absolute discretion of the Sponsor: (i) it is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) it is not in compliance with these Rules (including, but not limited to, the specific Participation Requirements listed below), all as determined by the Sponsor in its sole and absolute discretion.

6.    VERIFICATION:

All Contest-Related Information and entrants are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government-issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Information and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) used by the Sponsor. Proof of transmission (screenshots or captures etc.) or attempted transmission of any communication, does not constitute proof of delivery or receipt by the Sponsor.

7.    PARTICIPATION REQUIREMENTS:

BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR PARTICIPATION (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE APPLICABLE PRIZE (INCLUDING ANY USE OR MISUSE OF THE APPLICABLE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE.  

By participating in the Contest, each entrant hereby warrants and represents that any Contest-Related Information he/she submits does not contain any reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence, and will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party.

8.    PRIZES:

At the start of the Contest Period, there are seventy-three (73) prizes (each, a “Prize”) available to be won: (a) three (3) grand prizes (each, a “Grand Prize”); and (b) seventy (70) secondary prizes (each, a “Secondary Prize”), as set out below.   

(a) Grand Prizes 

There are three (3) Grand Prizes available to be won. Each Grand Prize consists of the opportunity for the confirmed winner and one (1) guest (subject to Guest Requirements noted below – the “Guest”) to travel to a city hosting the 2024 Stanley Cup® Final (“Host City”). Specific travel dates and Host City will be determined at a later time and will be confirmed by the Sponsor in its sole discretion. Each Grand Prize includes: (i) roundtrip airfare (economy class)  for the confirmed winner and his/her Guest to the Host City from a Canadian airport near the confirmed winner’s residence (as determined by Sponsor in its sole and absolute discretion); (ii) accommodation for the confirmed winner and his/her Guest (double occupancy) for two (2) nights in a hotel or hotels determined by Sponsor in its sole and absolute discretion; (iii) $1000 CAD spending money for the confirmed winner; (iv) two (2) NHL® player-signed items (determined by Sponsor in its sole and absolute discretion); and (v) two (2) general admission tickets to attend Game 2 or Game 3 of the 2024 Stanley Cup® Final (the “Game”). As between Sponsor and the Contest winners and Guests, Game selection, seating and location will be determined by the Sponsor in its sole and absolute discretion.  

Each Grand Prize has a total approximate retail value of $10,000 CAD based on a Toronto departure and Tampa Bay Host City hypothetical example – although the actual retail value will vary depending on the point of departure and Host City.  Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded. Choice of flights, airline(s), hotel accommodations (including, without limitation, room size and occupancy) and all other aspects of each Grand Prize are at the sole and absolute discretion of the Sponsor.  

Without limiting the generality of the foregoing, the following general conditions apply to each Grand Prize: (i) Grand Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) all travel related to the Grand Prize must occur within and/or on or before the date or dates specified by the Sponsor (otherwise the Grand Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner and his/her Guest must: (a) have all necessary documentation to permit travel (including, if required, international travel to the United States of America and re-entry to Canada); and (b) travel on the same itinerary as set by or on behalf of the Sponsor; (v) the costs of everything not specifically and expressly stated above as included in the Grand Prize are the sole and absolute responsibility of the confirmed winner and his/her Guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; the cost and expense of any required COVID-19 testing; transportation for confirmed winner and his/her Guest to and from the Canadian departure airport selected by the Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: confirmed winner and/or his/her Guest may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if the confirmed winner and/or his/her Guest do not utilize any part(s) of the Grand Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; (ix) by accepting the Grand Prize, the confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) the confirmed winner and his/her Guest must participate in the Grand Prize in a respectable manner and abide by all applicable venue policies including any rules and regulations related to COVID-19 - the Sponsor reserves the right to revoke any component of the Grand Prize from the winner or Guest who it, or applicable venue personnel, deem (in their sole discretion) as a safety risk, having violated any applicable policy or law, or may be bringing Sponsor or any of the other Contest Parties into disrepute (and for greater certainty, nothing will be substituted in place of any revoked Grand Prize component); and (xi) by participating in the Grand Prize, the confirmed winner and his/her Guest each: (a) signifies that he/she understands, acknowledges and accepts that participation in the Grand Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he/she may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that he/she acknowledges and agrees that the Released Parties have not made any warranties, guarantees or representations about his/her safety while participating in the Grand Prize; and (c) warrants and represents that he/she has evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agrees and assumes any and all such risks arising out of or connected with his/her participation in the Grand Prize.

Guest Requirements: Each confirmed winner’s Guest must: (a) either be of the legal age of majority in his/her jurisdiction of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner on the Grand Prize trip; and (b) sign (and have his/her parent/legal guardian if he/she is under the legal age of majority in his/her jurisdiction of residence) and return the Sponsor’s release (by the date indicated on the release form) indicating (among other things) that he/she waives all recourse against the Sponsor and all of the other Released Parties relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto). 

In the event that a confirmed winner resides within a three hundred (300) km radius of the Host City (as determined by the Sponsor in its sole and absolute discretion), Sponsor will determine, in its sole and absolute discretion, whether or not the applicable Grand Prize will include airline travel, another form of transportation to and from the Host City, or reimbursement for certain incurred fuel costs. All decisions of the Sponsor in this regard will be final and binding without right of appeal.

It is strongly recommended and encouraged that each confirmed winner and his/her Guest obtain sufficient personal travel and medical insurance prior to departure. Flights are subject to availability, blackout periods, government restrictions and regulations, airline, airport or other transportation restrictions and regulations. The Sponsor and other Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of a Grand Prize – including, but not limited to flight(s) and/or the Game. Neither a confirmed winner nor his/her Guest nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The Sponsor will not replace any lost or stolen tickets. Changes to flights and/or passenger names are not accepted once bookings have been confirmed.

The number of Secondary Prizes available in the Contest will decrease as they are claimed in accordance with these Rules. 

The following general conditions apply to each Secondary Prize: (i) each Secondary Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at the Sponsor’s option; (iii) the Sponsor reserves the right to substitute a Secondary Prize in whole or in part in the event that all or any component of such Secondary Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (iv) all characteristics and features of each Secondary Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; and (v) each Secondary Prize winner is solely responsible for all costs not expressly described herein. NHLShop.ca gift cards are subject to terms and conditions.

Without limiting any of the foregoing, each Kruger Products Value Coupon Secondary Prize is redeemable towards the purchase of one (1) package of Kruger Products Inc. merchandise, any size or variety, up to a maximum retail value of $20 CAD.  Limit one (1) coupon per purchase, valid in Canada only. Each Kruger Products Value Coupon Secondary Prize expires December 31, 2024. 
The Sponsor and the other Released Parties make no representation and do not offer any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize each confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.  

9.    ELIGIBLE WINNER SELECTION AND NOTIFICATION PROCESS:

(a) Eligible Location Winner 

The first participant to complete an eligible Guess during the Participation Period that correctly identifies the exact (or, the participant that identifies the closest to exact as of the end of the Participation Period, if no eligible Guess is completed that correctly identifies the exact) location of the Website’s virtual Stanley Cup® (as determined by the Sponsor in its sole and absolute discretion) will be eligible to win one (1) Grand Prize (the “Eligible Location Winner”). The odds of being the Eligible Location Winner and winning the applicable Grand Prize will depend on the number, timing and accuracy of eligible Guesses submitted and received in accordance with these Rules during the Participation Period.  

The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the Eligible Location Winner by May 19, 2024, via email and/or telephone. The Eligible Location Winner is solely responsible for ensuring he/she is able to receive such notification messages, monitoring for such notification messages and following all instructions contained in such notification messages, failing which, he/she may be disqualified (as determined by the Sponsor at its sole discretion). If the Eligible Location Winner cannot be contacted as outlined above, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate Eligible Location Winner in accordance with the procedure outlined above, with the necessary amendments (in which case the foregoing provisions of this section shall apply to such newly selected Eligible Location Winner).

(b) Eligible Instant Winners 

During the Participation Period, there are a total of seventy (70) winning times (each a “Winning Time”), one (1) Winning Time per Day. Winning Times will be randomly generated and randomly seeded throughout the Participation Period. The first eligible entrant who receives an eligible Entry in accordance with these Rules on or immediately after a Winning Time will receive a Winning Message (defined below) and will be eligible to win the Secondary Prize associated with that Winning Time (an “Eligible Instant Winner”). The Secondary Prize associated with each Winning Time will be randomly determined. For greater certainty and the avoidance of any doubt, all Secondary Prizes will be associated with Winning Times in the Contest. If no eligible Entry is received on or after a Winning Time before the next Winning Time, the eligible entrant who first receives an eligible Entry in accordance with these Rules following the second Winning Time will be eligible to win only the Secondary Prize associated with the first Winning Time. The next eligible entrant who receives an eligible Entry in accordance with these Rules following this will then be eligible to win the Secondary Prize associated with the second Winning Time (and so forth). The odds of being an Eligible Instant Winner and winning an applicable Secondary Prize depend on the number and timing of eligible Entries received in accordance with these Rules during the Participation Period. 

Upon receipt of an Entry in accordance with these Rules, each participant will automatically be notified on-screen on the Website as to whether or not he/she is an Eligible Instant Winner. If a participant is an Eligible Instant Winner, then he/she will automatically be notified on-screen on the Website with a message indicating that he/she is eligible to win the specified Secondary Prize (the “Winning Message”). If a participant is not an Eligible Instant Winner, then he/she will automatically be notified on-screen on the Website accordingly. 

Any discrepancy between the Secondary Prize listed in the on-screen notification of a Winning Message (or otherwise) or on the Declaration and Release form (where applicable), will default to the Secondary Prize listed in the Sponsor’s official Contest database. 

(c) Eligible Draw Winners

On May 14, 2024 (the “Selection Date”) in Toronto, Ontario at approximately 12:00 p.m. ET, the Sponsor or its designated representative will perform a random draw from among all eligible Entries submitted and received in accordance with these Rules during the Participation Period to select two (2) participants who will each be eligible to win a Grand Prize (each, an “Eligible Draw Winner”). The odds of being an Eligible Draw Winner and winning an applicable Grand Prize depend on the number of eligible Entries submitted and received in accordance with these Rules during the Participation Period.

The Sponsor or its designated representative will make a minimum of two (2) attempts to contact each Eligible Draw Winner by May 18, 2024, via email and/or telephone. Each Eligible Draw Winner is solely responsible for ensuring he/she is able to receive such notification messages, monitoring for such notification messages and following all instructions contained in such notification messages, failing which, he/she may be disqualified (as determined by the Sponsor at its sole discretion). If an Eligible Draw Winner cannot be contacted as outlined above, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate Eligible Draw Winner in accordance with the procedure outlined above, with the necessary amendments (in which case the foregoing provisions of this section shall apply to such newly-selected Eligible Draw Winner).

The Sponsor’s decisions with regards to all aspects of the Contest and the awarding of Prizes are final and binding without right of appeal. 

There is a limit of one (1) Grand Prize per household. There is a limit of two (2) Secondary Prizes per household. Secondary Prize winners remain eligible to win a Grand Prize. However, Grand Prize winners are no longer eligible to win a Secondary Prize (for certainty, upon being declared the Eligible Location Winner or an Eligible Draw Winner of a Grand Prize, a participant is not eligible for a subsequent Prize). 

10.    ELIGIBLE WINNER CONFIRMATION PROCESS:

NO ONE IS A PRIZE WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A PRIZE WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING CONFIRMED AS A PRIZE WINNER, the Eligible Location Winner, each Eligible Instant Winner and each Eligible Draw Winner will: (a) be required to correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) may, in the sole and absolute discretion of the Sponsor, be required to sign and return within seven (7) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable Prize (as awarded); (iii) releases the Sponsor and all of the other Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize; and (iv) agrees to the publication, reproduction and/or other use of his/her name, city and province/territory of residence, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the Internet.  If an eligible Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to properly execute and return Contest documents within the specified time (as applicable); (c) cannot accept (or is unwilling to accept) the applicable Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the applicable Prize).  

Any Prize(s) that are not or cannot be awarded in accordance with these Rules will be null and void and will not be awarded. 

11.    GENERAL CONDITIONS:  

This Contest is subject to all applicable federal, provincial, and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual that it deems to be in violation of these Rules. The Sponsor reserves the right to refuse participation by any person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter.  In its sole and absolute determination, the Sponsor may disqualify any person who acts in any manner to threaten or abuse or harass any other person.

The Released Parties will not be liable for: (i) any failure of any website or any platform during or after the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-Related Information, winner notification message, and/or any other information or materials whatsoever to be received, captured, recorded or function properly for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above. 

The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately, the Sponsor reserves the right, in its sole and absolute discretion, to rescind invalid Prize claims and/or conduct a random draw from amongst all eligible claimants to award the correct number and type of Prizes as specified in these Rules.  In no event whatsoever will the Sponsor or any of the Released Parties be liable for more than the number, type and value of Prizes as stated in these Rules.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy (available at: http://www.krugerproducts.ca/privacy.php). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance by any entrant and/or any other information or materials with these Rules, or as a result of any problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, any other website(s), the French version of these Rules, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.
